State Representative Doug Wozniak from Shelby Township has introduced a bill aimed at clarifying Michigan's real estate laws. The proposed legislation seeks to amend the Marketable Record Title Act, focusing on the preservation of interests in land. The intention is to prevent outdated or vaguely worded claims from disrupting property ownership.
"This legislation is about protecting property owners and ensuring our land records reflect true, enforceable rights," stated Wozniak. He emphasized that the bill aims to close loopholes used to challenge ownership with old and ambiguous claims.
Current laws allow ownership challenges despite a clear title history spanning decades. The new bill proposes that only clearly stated and properly preserved interests will remain valid after the marketable title period. Deeds or mortgages that merely reference an interest without explicit preservation will not be sufficient for upholding a claim. Vague language will also be rejected in maintaining an interest, with only well-documented claims like easements, leases, or deed restrictions remaining enforceable.
"The goal is to make our land records stronger and more predictable, which is good for homeowners, buyers, real estate professionals, and the courts," Wozniak added. He highlighted that ambiguity in land documents should not lead to confusion or unexpected challenges to long-held property rights.
