State Representative Doug Wozniak, a Republican from Shelby Township, has put forward a legislative proposal aimed at updating the Michigan Estates and Protected Individuals Code (EPIC). The focus of this bill is to clarify important rules concerning the court's authority in appointing individuals to enforce trusts.
"As more Michiganders use trusts in their estate plans, it’s essential that our laws keep pace," Wozniak stated. "This bill helps ensure transparency, fairness, and proper oversight in trust matters."
The proposed legislation includes several key updates. It aims to clarify who qualifies as a beneficiary, confirm the court's authority to appoint trust enforcers, and revise rules related to trust no-contest clauses.
"Trusts are about preserving legacies," Wozniak explained. "This bill would ensure that the courts can enforce a trust’s intent while protecting the rights of those involved. It would provide clarity and confidence families need when planning for the future."
